Our commitment to protect your privacy

Our commitment in respect of personal information is to abide by the Australian Privacy Principles for the protection of personal information, as set out in the Privacy Act 1988 (Privacy Act), the Privacy (Credit Reporting) Code 2014 (Credit Reporting Code) and any other relevant laws.

Personal information

Personal information refers to data that can reasonably identify you, such as your name, date of birth, address, email, phone number, account details, occupation, transaction history, and other identifying details. For finance applications, we may collect data on your dependents, cohabitants, current address duration, employment details, earnings, expenses, and tax status. 

When using our websites or apps, we gather location info, IP address, mobile device, network information, and third-party site access. For specifics, see the ‘Cookies’ section below. The personal information we handle may include credit-related details.

Credit-related information means:

Credit information refers to personal data or opinions that are relevant to credit that you have received or applied for. This encompasses details about your identity; the type, terms, and maximum amount of credit provided to you, including the dates when the credit was granted and repaid; repayment history; default information (such as overdue payments); payment details; new arrangements; financial hardship arrangements, including any such agreements made with us; records of serious credit infringements; court proceedings; personal insolvency details; and publicly accessible information.

Credit eligibility information refers to credit reporting information provided to us by a credit reporting body, including any information derived from it. We use your credit-related information to evaluate your suitability for finance. Typically, credit-related information is shared between credit and finance providers and credit reporting bodies.

If you make purchases from or through us, we collect your payment information. We also gather this information if payments need to be made to you. For employment applications, we collect information regarding your work history and obtain references about you.

Why we collect your personal information

We gather and receive personal information about you, including credit-related information, to conduct our business. This includes assessing your application for finance, managing that finance, establishing your identity, contacting you, managing our risk, and complying with legal obligations. We may also collect your personal information for direct marketing and managing our relationship with you. Technological advancements enable organizations like ours to collect and use information to gain a more integrated view of customers. Occasionally, we may offer additional products and services.

If you apply to become a finance broker or seek employment with us, we will collect information to determine whether to appoint you and subsequently manage the relationship, including offering other services and products.

We collect payment information to process your payments.

How do we collect your personal information?

We collect your personal information directly from you when possible. Additionally, we gather publicly available information from sources such as public registers or social media, and information provided by third parties. We also obtain personal information from credit reporting bodies, finance brokers, employers, accountants, lawyers, and referees.

Do we disclose your personal information?

We may disclose your personal information:

  • to existing or prospective funders or other intermediaries in relation to your finance requirements;
  • to other guarantors, borrowers, and other security providers (if more than one);
  • to borrowers or prospective borrowers, including in relation to any credit you guarantee or propose to guarantee;
  • to other organisations that are involved in managing or administering your finance such as valuers, surveyors, third-party suppliers, printing and postal services, call centres, lenders mortgage insurers, trade insurers, recovery firms, debt collectors, lawyers, and credit reporting bodies;
  • to our agents, contractors, or external service providers to outsource certain functions, for example, statement production, debt recovery, and information technology support;
  • to businesses we have a relationship with that may want to market products to you;
  • to companies that provide information and infrastructure systems to us;
  • to anybody who represents you, such as finance brokers, lawyers, guardians, persons holding power of attorney and accountants;
  • to anyone, where you have provided us consent;
  • to our auditors, insurers, re-insurers, and health care providers;
  • to claims related providers, such as assessors and investigators who assist us with claims;
  • where we are required to do so by law, such as under the Anti-Money Laundering and Counter Terrorism Financing Act 2006 or in accordance with a subpoena or summons issued by a court;
  • to organisations involved in our funding arrangements such as trustees, warehouse funders, investors, rating agencies, agents, auditors, advisors, or any entity that has an interest in our business or your finance; or
  • to your current or previous employer, referees, or identity verification services.

Prior to disclosing any of your personal information to another person or organisation, we will take all reasonable steps to ensure that:

  • the individual or organisation has a commitment to protecting your personal information at least equal to our commitment, or
  • you have consented to us making the disclosure.

We use cloud storage to store personal information. The cloud storage and IT servers may be located outside Australia. We may disclose your personal information to overseas entities that provide support functions to us (including in the USA, Canada, Malaysia, India, Ireland, the United Kingdom, and the Philippines). You may obtain more information about these entities by contacting us.

New technologies and data analytic software allow us to combine information we have about you and our other customers, with data sources such as third-party websites or the Australian Bureau of Statistics. We can analyse this data to learn more about you and other customers, and how to improve our products and services. While we may use this combined data to help other businesses better understand their customers, we will not provide any personal information about you unless legally required to do so.

Credit-related information

We exchange credit-related information to evaluate your finance application and manage the finance. If you propose to be a guarantor, we may obtain a credit report about you.

The credit-related information we hold may be stored electronically on our secure servers and in paper form. We use cloud storage for personal information, including credit-related information. The cloud storage and IT servers may be located outside Australia.

When we obtain credit eligibility information from a credit reporting body, we may also seek publicly available information and details of any serious credit infringement committed by you.

We may disclose your credit-related information to overseas entities that support us (including those in USA, Canada, Malaysia, India, Ireland, the United Kingdom, and the Philippines). You may contact us for more information about these entities. If we disclose your credit-related information to overseas entities, we ensure appropriate data handling and security measures are in place.

The credit reporting bodies we use are Equifax Pty Ltd, Experian Australia Credit Services Pty Ltd, and Illion Australia Pty Ltd. Their privacy policies can be downloaded at: equifax.com.au, experian.com.au, or illion.com.au.

Notifiable matters

The law requires us to inform you about ‘notifiable matters’ related to how your credit-related information may be used. You can request these notifiable matters (and this privacy policy) in an alternative format if needed.

We share your credit-related information with credit reporting bodies. This information is used to confirm your identity, evaluate your creditworthiness, process your finance application, and manage your finance.

Credit reporting bodies may share the information we provide with other credit providers to help them assess your creditworthiness. We also use information from other credit providers obtained through credit reporting bodies in our assessments.

The exchanged information includes your identification details, loan types, borrowed amounts, loan payment status, and any serious credit infringements (such as fraud).

If you fail to meet your payment obligations or commit a serious credit infringement, we may report this to a credit reporting body.

You have the right to access the credit-related information we hold about you and request corrections if necessary. Refer to the section titled ‘Access and correction to your personal and credit information’.

Credit reporting bodies may use your credit-related information for ‘pre-screening’ credit offers at the request of other credit providers. You can contact the credit reporting body to opt-out of this usage.If you believe you are a victim of fraud, notify the credit reporting body. They will not use or disclose your information for 21 days following your notification. Notifiable Data Breaches

The Privacy Act includes the Notifiable Data Breaches (NDB) scheme, requiring us to inform you and the Office of the Australian Information Commissioner (OAIC) about certain data breaches and suggest steps like changing your password.

The NDB scheme mandates notification for data breaches likely causing serious harm. Exceptions are made if remedial actions have already mitigated the risk.

If a breach affects your personal information and poses a serious harm risk, we’ll notify you and the OAIC promptly and provide updates on the breach, our actions, and what you can do. If you suspect your personal information has been breached, contact us.

Direct Marketing

We may occasionally use your personal information to inform you about finance offers, changes to our organisation, or new products or services from us or our partners. To opt out of marketing emails, use the unsubscribe function or email us. We won’t charge for this service and will process your request promptly.

Updating your personal information

It is necessary that the personal information we hold about you, such as your current home address, email address, and phone number, is accurate and up to date. During our relationship with you, we may request that you inform us if any of your personal information has changed.

If you need to make any changes to your personal information, please contact us. We will generally depend on you to ensure that the information we hold about you is accurate and complete.

Access and Correction of Personal and Credit Information

We will grant you access to the personal and credit-related information that we possess about you. You may request access at any time.

A fee may be charged to cover the costs of retrieving and supplying the requested information. Depending on the nature of your request, our response may be immediate or within 30 days of receiving your request. We may need to contact other entities to thoroughly investigate your request.

There are circumstances where access to your personal or credit-related information may be denied, such as if the information is commercially sensitive, pertains to ongoing or anticipated legal proceedings, or if the request is deemed vexatious. If access is denied, an explanation will be provided.

If any personal or credit-related information we hold about you is incorrect, inaccurate, or outdated, you may request correction. If appropriate, we will correct the information promptly. An initial response will be provided within seven days of receiving your request. Where reasonable, we will finalize our investigation and notify you of any corrections within 30 days.

Consultation with external entities may be necessary during our investigation. If we refuse to correct the information, we will provide an explanation outlining our reasons.

Using government identifiers

We collect government identifiers, like your tax file number, only as required by law. We will not use them to identify you or disclose them beyond legal requirements.

Business without Identifying You

While we usually need to identify you to conduct business, we will provide opportunities to interact without personal information when lawful and feasible, such as general inquiries about interest rates or promotions.

Sensitive information

Sensitive information will be collected only with your consent. It includes personal details such as racial or ethnic origin, political views, memberships in trade or professional associations or trade unions, sexual preferences, criminal record, or health and biometrics (for example, fingerprints).

How safe and secure is your personal information that we hold?

We take steps to protect your personal information by storing it in a secure environment. Your personal information may be stored in paper or electronic form. We also take measures to prevent misuse, loss, unauthorised access, modification, or disclosure of any personal information.

Complaints

If you’re unhappy with how we’ve handled your personal or credit-related information, or our compliance with the Privacy Act and Credit Reporting Code, contact us. We’ll acknowledge your complaint within seven days and aim to resolve it within 30 days. If more time is needed, we’ll inform you of the extension.
